Terms & Conditions

This legal document is all about creating the highest level of safety and clarity for each student, and for the Institute. Please bear with the “legalese” that oftentimes is required for such purposes.

The Institute for the Psychology of Eating (“IPE” or the “Institute”) offers several public and professional programs, including but not limited to The Mind Body Eating Coach Certification Training, The Emotional Eating Breakthrough, and Transform Your Relationship with Food. We offer psychologyofeating.com, courses.psychologyofeating.com, tyrf.psychologyofeating.com, and their related products and services (together collectively referred to as the “Site”) to you conditioned on your acceptance without modification of the conditions, terms, and notices contained herein (the “Terms”). You agree to be bound by the terms and conditions of this agreement through your access or use of the Site. Your continued use of the Site either now or following the posting of any revisions, shall indicate your acceptance of these terms and conditions, as well as any future changes.  

Privacy & Confidentiality Agreement:

You hereby acknowledges the following confidentiality agreement – please read carefully:

We at the Institute for the Psychology of Eating are committed to functioning as a business and educational organization with integrity. Please understand that the value of our programs is in the course materials, and that you are on the honor system in terms of keeping all course materials confidential to you, and only you. 

Importantly, this means that you do not:

  • Give away, share, copy, repurpose, or resell your course materials, whether videos, audios, handouts, downloads, or any other course materials with anyone else.
  • Share your login credentials (“username,” “password” or any other login information) to the Site’s online training platforms.
  • In other words, you have paid and enrolled for your use ONLY.
  • You will not repurpose, reproduce, reuse, or sell any of the material you’ve learned in our programs in any way.
  • You will be honest and forthright about these agreements and reach out to us when you are unclear in any way about the use of Site materials.

We ask that you keep to your word. To do otherwise violates not only copyright and confidentiality laws, but cosmic law as well. We believe that “what goes around comes around,” so please join us in creating a world of honesty, integrity and good will.

We respect your privacy and ask that you respect the privacy of fellow program participants. We respect your confidential and proprietary information ideas, plans and trade secrets (collectively, “Confidential Information”) and require that you respect the same rights of fellow program participants and of the Company, IPE. 

Thus, you agree:

  • Not to infringe copyright, patent, trademark, trade secret or other intellectual property rights of any other Program participants or of IPE;
  • That any Confidential Information shared by Program participants or any representative of IPE is confidential and Proprietary, and belongs solely and exclusively to the Participant who discloses it or IPE;
  • Not to disclose such information to any other person or use it in any manner other than in discussion with other Program participants during Program sessions;
  • That all materials and information provided to you by IPE are its confidential and proprietary intellectual property belong solely and exclusively to IPE and may only be used by you as authorized by IPE;
  • The reproduction, distribution and sale of these materials by anyone but IPE is strictly prohibited;
  • That if you violate, or display any likelihood of violating, any of your agreements contained in this paragraph, IPE and/or the other Program participant(s) will be entitled to injunctive relief to prohibit any such violations to protect against the harm of such violations.

The phrase ‘Confidential Information’ as used in this policy, includes but is not limited to, any and all information which is not generally known to the public, related to or concerning: (a) Marc David and his business or personal life (b) the business activities, dealings or interests of IPE, and/or its officers, directors, affiliates, employees or contractors; and (c) any confidential information, knowledge and know-how, concerning the operations, products, services, procedures, or customers of IPE, in any format whatsoever, including, without limitation, the techniques, formulations, organization, design, implementation, preparation and other operations, methods, and accumulated experiences incidental thereto, and further including, without limitation, information relating to financial results, marketing techniques, advertising, policies, procedures, promotions, customer lists, mailing lists, concepts, ideas, trade secrets, other proprietary information, training materials, teaching aids, and/or research of IPE. Further, any and all Confidential Information which by its nature is confidential or which IPE in its sole and absolute discretion, designates as such shall be deemed Confidential Information for purposes of this Agreement.

While you are free to discuss your personal results from our programs and training, you must keep the experiences and statements, oral or written, of all other participants in the strictest of confidence. Simply put, we want all of our students and customers to feel safe, honored and respected.

Thank you in advance for your commitment to confidentiality.

A word about using the Mind Body Eating Coach Certification Training materials, specifically:

This is a very information-rich training containing handouts, slide presentations, and more. Students are often interested to know how they can use the course materials for their own programs or clients.

Here are the guidelines to help you understand the use of course materials:

  • Under copyright law, NO materials from the Institute for the Psychology of Eating may be reproduced or redistributed for any purposes without our EXPLICIT written consent.
  • Videos, audios, slide shows, and any other course materials may NOT be shared with others.
  • You may use up to several paragraphs of written material that is quoted verbatim (word-for-word) as long as that written material is referenced as coming from “Marc David and the Institute for the Psychology of Eating.”

Additionally, you agree to and acknowledge the following about the content for the Mind Body Eating Coach Certification:

  • Program education and information is intended for a general audience and does not purport to be, nor should it be construed as, specific advice tailored to any individual.
  • The IPE programs and materials are guides intended to educate IPE students. The end-use of the materials is solely in the discretion of the student.
  • All materials, procedures, policies, and standards, all teaching manuals, all teaching aids, all supplements and the like that have been or will be made are for personal use in or in conjunction with this training program only.
  • Program content is for personal use only, and may not be sold, tape recorded, videotaped, shared, taught, given away, or otherwise divulged without the express written consent of IPE.
  • The information contained in Site material is strictly for educational purposes. Therefore, if you wish to apply ideas contained in this material, you are taking full responsibility for your actions.
  • Nothing in the language of this agreement or the Site content is intended to create the guarantee, impression or promise of employment or continued employment. IPE cannot, in any way, guarantee employment after the student has successfully completed the program of study. We assume no responsibility for errors or omissions that may appear in any Site materials. We do our absolute best to be thorough, complete, and on point with all of our material.

Right to Refuse:

We are committed to providing all participants in our programs with a positive experience. Thus, The Institute for the Psychology of Eating, Inc. (IPE) may, at its sole discretion, limit, suspend, or end your participation in any of its programs if:

  • You become disruptive to IPE’s staff or business activities;
  • You fail to follow the program guidelines; or,
  • You impair the participation of participants in the program.

Additionally, we reserve the right in our sole discretion to refuse or terminate your access to the Site at any time without notice.

In the event that either you or the Institute wish to terminate the Site, please note that the termination terms shall continue to apply to you, even after termination by either party.

Upon cancellation or termination, all remaining balances owed shall be immediately due, and you will no longer be authorized to use the Site. The restrictions imposed on you with respect to the Site, and all course materials, trainings, and products, including but not limited to all of the disclaimers, limitations of liabilities, and rights set forth in these Terms of Use, shall survive such termination of your access and apply in full force.

The Institute for the Psychology of Eating Code of Conduct Requirements:

As a customer, student or alumni of The Mind Body Eating Coach Certification Training, or any of our public programs, you are required to adhere to the following code of conduct. We greatly appreciate your adherence to these policies:

  • Be respectful and courteous to your fellow student and alumni colleagues, as well as IPE’s teachers, coaches, and representatives.
  • Please do not use abusive, derogatory, threatening, or discriminatory language, either directly or indirectly. The Institute makes every effort to create a positive, inclusive, and uplifting community, and we ask that you do the same through your word and conduct.
  • Additionally, we ask that you refrain from discriminating or harassing on the basis of any legally protected classification, including, but not limited to race, gender, age, disability, national origin, religion, sexual orientation, or gender identity.

Please do not directly contact any coach, instructor, or employee of the Institute for the Psychology of Eating for any reason. Customer Support requests or issues should be directed exclusively to info@psychologyofeating.com

The Institute for the Psychology of Eating (IPE) does not discriminate on the basis of race,

nationality, sex, religion, ethnic origin, sexual orientation, or disability.

We recommend a minimum age of 18 years old for attendance in any of our programs.

IPE does not have any religious affiliation.

Limitation of Liability:

Under no circumstances shall the Institute be liable to you or anyone else for any direct, indirect, incidental, special or consequential damages, personal injury, or property damage of any kind or nature whatsoever that arise out of, or result from: (1) the use of, or any inability to use, the course materials; or (2) any act or omission, online or offline, of student or anyone else, even if the Institute has been advised of the possibility of these damages. In no event shall the company’s total liability to you for any and all loss, damage, cost, liability, or expense (including any legal fees) that student may incur, under any theory of liability, in contract, tort (including but not limited to negligence), or otherwise, exceed the amount paid by the student to the Institute. 

Under no circumstances will the Institute or any of the other indemnified parties be liable for the delay or failure in performance resulting, whether directly or indirectly, from any event of force majeure or other cause beyond the Institute’s control, including, without limitation, acts of God, war, equipment or technical failures, internet outages, natural disasters, governmental actions, orders of domestic or foreign courts or tribunals, or non-performance of third parties.

Severability:

If any provision of this Agreement is found for any reason to be unlawful, void or unenforceable, then that provision will be given its maximum enforceable effect, or shall be deemed severable from this Agreement, and will not affect the validity and enforceability of any remaining provision. 

Revisions & Modifications:  

The Institute reserves the right to change, at any time, the terms and conditions under which the Site is offered. Please note that it is your responsibility to check periodically for any changes we may make to the terms and conditions. Your continued use of this Site following the effective date of changes to these Terms or other policies indicates your acceptance and consent to the changes.

Assignment: 

We may assign our rights under this Agreement, in whole or in part, to any person or entity at any time with or without your consent. You may not assign the Agreement without our prior written consent, and any unauthorized assignment by you shall be null and void. 

No Waiver:

Our failure to enforce any provision of this Agreement shall in no way be construed to be a present or future waiver of such provision, nor in any way affect the right of any party to enforce each and every such provision thereafter. The express waiver by us of any provision, condition or requirement of this Agreement shall not constitute a waiver of any future obligation to comply with such provision, condition or requirement. 

Disclaimer:

The Institute for the Psychology of Eating cannot guarantee your results, accomplishments, or earnings achieved from the use of our programs. Please note that we cannot provide you with professional, business, and/or legal advice. Your results as an individual, student, coach or practitioner are yours alone, and incumbent on your mastery of the course materials, as well as your own hard work and efforts to apply it. 

The Mind Body Eating Coach Certification Training

Payment:

You agree to pay The Institute for the Psychology of Eating the full tuition due, whether paying in full, or by a payment plan. Payment of all monies due shall be a condition of continuing enrollment.

Upon completion of the course, the school will award you a “Certificate of Completion.” Please note that you will not receive your Certificate until your tuition has been paid in full.

If paying by credit or debit card, you permit and authorize the Institute for the Psychology of Eating to automatically charge your credit or debit card as payment for the Mind Body Eating Coach Certification Training. If you use our payment plan option, you agree to pay the initial payment, as well as all other payments on the order form. By using the order form, you give the Institute permission and authorization to automatically charge your credit or debit card until all payments are completed.

In the event that the Institute does not receive payment by the due date, please note that you will have seven (7) days in which to make payment. Otherwise, your access and entitlement to the Mind Body Eating Coach Certification Training shall be discontinued. Additionally, you agree that, should you fail to make payment in a timely manner in accordance with this Agreement, or decide to withdraw from the Program at any time for any reason, you will remain fully responsible to pay any outstanding balance due for the Mind Body Eating Coach Certification Training. 

When you purchase the Mind Body Eating Coach Certification Training, your credit card, contact, and other information you provide as part of the transaction may be collected by both us and a third-party merchant. The third-party merchant may have data collection and privacy practices that are different from ours. Therefore, please note that we have no responsibility or liability for the merchant’s independent policies. 

You agree to purchase and use the Mind Body Eating Coach Certification Training for legitimate purposes only in compliance with the terms and conditions of this Agreement. You agree to not make any purchases for false, speculative, or fraudulent purposes. You release us and any affiliates of ours from any damages you may incur, and you agree not to assert any claims about us or them, arising from your purchase of the Program.

You agree to purchase the Mind Body Eating Coach Certification Training only for yourself or for  another person for whom you are legally permitted to do so. If you make a purchase for a third party, should you be required to submit the third party’s personal or financial information to us or a merchant, you represent that you have obtained their consent to provide such third party’s personal information.

Cancellation and Refund Policy:

The Institute has made every effort to give you, our valued student, the very best educational experience possible. We understand that there may be various instances where you determine you must withdraw from the Program. In this instance, any refund relative to withdrawal from the Program depends on when you notify the Institute in writing that you need to withdraw from the Program.

Given this, please note the following refund policy for the Mind Body Eating Coach Certification Training:

If, for any reason, you decide to withdraw from the Program, you can receive a full refund less a $250 administrative fee within the first 7 days after initial payment. To receive a full refund, simply email us at mbecc@psychologyofeating.com within 7 days of enrolling, and let us know you would like to withdraw, along with your reason for withdrawing.

Please note that, after the first 7 days from initial payment, no refunds are permitted. You hereby acknowledge that all monies will be forfeited from this point onward, regardless of circumstances or reason for cancellation.

If you have not paid in full and are using a payment plan, you also acknowledge that, in the event you withdraw from the Program, you are responsible for any outstanding payments that you may owe the Institute, regardless of your explicit withdrawal from the Mind Body Eating Coach Certification Training. 

All refunds due will be made within thirty (30) calendar days of the date of cancellation. The date of cancellation is the date the student gives written notice of withdrawal by email to IPE, or the date IPE terminates student enrollment pursuant to IPE’s Attendance, Conduct, and Academic Policy. 

Refunds will be in USD, and made to the payment method on file at the time the refund is processed by IPE. IPE shall not be liable in the event of any foreign exchange rate differences between the purchase price of the Program, and the refund amount.

The Emotional Eating Breakthrough

Payment:

You agree to pay The Institute for the Psychology of Eating the full course fees, whether paying in full, or by a payment plan. Payment of all monies due shall be a condition of continuing enrollment.

If paying by credit or debit card, you permit and authorize the Institute for the Psychology of Eating to automatically charge your credit or debit card as payment for the Emotional Eating Breakthrough. If you use our payment plan option, you agree to pay the initial payment, as well as all other payments on the order form. By using the order form, you give the Institute permission and authorization to automatically charge your credit or debit card until all payments are completed.

In the event that the Institute does not receive payment by the due date, please note that you will have four (4) days in which to make payment. Otherwise, your access and entitlement to the Emotional Eating Breakthrough shall be discontinued. Additionally, you agree that, should you fail to make payment in a timely manner in accordance with this Agreement, or decide to withdraw from the Program at any time for any reason, you will remain fully responsible to pay any outstanding balance due for the program.

When you purchase the Emotional Eating Breakthrough, your credit card, contact, and other information you provide as part of the transaction may be collected by both us and a third-party merchant. You agree to purchase and use the Emotional Eating Breakthrough for legitimate purposes only in compliance with the terms and conditions of this Agreement. You agree to purchase the Emotional Eating Breakthrough only for yourself or for  another person for whom you are legally permitted to do so. If, for any reason, you decide to withdraw from the program, you can receive a full refund within the first 30 days after initial payment. To receive a full refund, please email us at info@psychologyofeating.com within 30 days of enrolling, and send us your completed assignments from at least 3 weeks of coursework, along with your reason for withdrawing. 

Please note that, after the first 30 days from initial payment, no refunds are permitted. You hereby acknowledge that all monies will be forfeited from this point onward, regardless of circumstances or reason for cancellation. 

If you have not paid in full and are using a payment plan, you also acknowledge that, in the event you withdraw from the Program, you are responsible for any outstanding payments that you may owe the Institute, regardless of your explicit withdrawal from the Emotional Eating Breakthrough.

All extra costs, such as books, supplies, and any similar charges are not subject to the refund computation but are limited to those materials that are distributed and attributable to the portion of the Program in which the student is enrolled.
